The Township of Huron-Kinloss is investigating improvements to the Black Creek Municipal Drain. Council appointed R.J. Burnside & Associates Limited under the Drainage Act to manage the project.

Council received a report on August 6, 2025 confirming the filing of the Engineer’s Report for the Black Creek Municipal Drain and outlining expected timelines to review the report. Black Creek Drain Update – Report from Engineer
The impacted watershed includes lands within the Township of Huron-Kinloss, the Municipality of South Bruce, and the Municipality of Brockton.

At the meeting to Consider the Engineers Report, Council referred the Report back to the Engineer to consider modifications. As part of these considerations, landowners may be contacted or see members of the project team on lands to survey, inspect or otherwise gather additional information. An information session may be held to consider information from landowners, and impacted properties will be provided notice if such occurs.
Once modifications have been considered and a report re-submitted, impacted property owners will be notified in accordance with the Drainage Act, of the public meeting to consider the Engineer’s Report. This meeting is to consider aspects of the design and the need to complete the works. Concerns regarding assessed values for each property are considered at a separate meeting (Court of Revision) as part of the Drainage improvement process.

The Township of Huron-Kinloss as the initiating municipality is required to host the public meeting to consider the report.
Copies of the report, assessments and notice of meeting have been mailed to impacted landowners. Landowners with assessment of less than $100 will not receive a printed copy of the report by mail.

Notice of Meeting to Consider the Engineer's Report

Activities at the meeting to consider the report:
- usually the engineer will present a summary of the report to Council
- for drains initiated by petition;
- petitioners will be given an opportunity to withdraw their name from the petition
- other owners that benefit from the drain will be given an opportunity to add their name to the petition
- Council must decide whether or not to proceed with the project by provisionally adopting the engineer's report by by-law; they also have the option to refer the report back to the engineer for modifications.
- All property owners affected by the drain will have an opportunity to influence Council's decision
- There is no right to appeal assessments or other aspects of the engineer's report at this meeting; these appeal rights will be made available later in the procedure. Drainage Act, R.S.O. 1990, c D.17, s. 47-54
